Terms of Service

These terms govern the use of the Stocker (SimpleStocker) app. They are the terms for electronically supplied services under the Polish Act of 18 July 2002 on providing services by electronic means. The Polish version prevails in case of discrepancies.

Effective from: 12 October 2026 · Wersja polska

1. Definitions

  • Provider ("we"): Sebastian Bolek, Zawada 12A, 64-930 Szydłowo, Polska, Polish tax ID (NIP) 7651656515, REGON 365641696, email [email protected].
  • App: the Stocker app for iOS, Android, Apple Watch and Wear OS together with the server it connects to.
  • User ("you"): a natural person who has created an Account.
  • Consumer: a User who is a consumer within the meaning of Art. 22¹ of the Polish Civil Code. Consumer provisions also apply to a sole trader for whom the contract is not of a professional nature (Art. 38a of the Polish Consumer Rights Act).
  • Account: your account in the App, created by signing in with a Google or Apple account.
  • Storage: a place for keeping supplies created in the App, such as a fridge or pantry.
  • Household member: a User the Storage owner has shared a Storage with.
  • Free Plan and Premium Plan: the service tiers described in section 6.
  • User Content: data you enter in the App, including product names, descriptions and photos.

2. Type and scope of services

Through the App we provide an Account service, which includes:

  • tracking products in Storages, with quantity, category and expiry date,
  • recognising products by barcode using the shared product catalog and the open Open Food Facts and Open Products Facts databases,
  • shopping lists, including automatic additions when a product runs out,
  • reminders about upcoming expiry dates,
  • sharing Storages and lists with Household members and real-time sync between devices,
  • Apple Watch and Wear OS companion apps.

These terms are available free of charge at simplestocker.com/en/terms in a form that lets you download, save and print them.

3. Technical requirements

  • an iPhone with iOS 16.4 or later, or an Android device with a version supported by the current App release on Google Play,
  • optionally: an Apple Watch paired with your iPhone, or a Wear OS watch,
  • internet access,
  • a Google or Apple account,
  • for scanning barcodes and taking photos: a camera and permission to use it.

Using the internet carries typical risks such as malware or account takeover attempts. Keep your system up to date and use a screen lock.

4. Account and conclusion of the contract

The service contract is concluded when you first sign in to the App and accept these terms. It is concluded for an indefinite period. The Free Plan is free of charge.

You must be at least 16 years old to create an Account. The Account is personal: do not share it with others; use the Household members feature for shared supplies.

You are responsible for securing your device and the Google or Apple account you sign in with. If you suspect someone has accessed your Account, sign out all devices and contact us.

5. Sharing with Household members

  • A Storage owner can invite others by entering their email address. Access is granted only after the invitee accepts.
  • Household members see the contents of the shared Storage and the owner’s name and email address, and can change its contents.
  • The owner can revoke access at any time, and a Household member can leave a Storage. When the owner deletes a Storage, it is also removed for Household members.
  • Only invite people who expect it and whose address you are entitled to give us.

6. Plans and payments

The Free Plan lets you keep 1 Storage with up to 10 products. During the testing period the App may work without limits; we will announce limits in the App in advance.

The Premium Plan is a subscription purchased in the App through the App Store or Google Play. You see its scope, price including taxes and billing period in the App and in the store purchase sheet before you buy.

  • Payment is collected and handled by Apple or Google under the rules of the store you use. We do not process your card details.
  • The subscription renews automatically for the next period until you cancel it. Cancel it in your App Store or Google Play subscription settings at least 24 hours before the end of the current period. After cancelling, the Premium Plan stays active until the end of the paid period.
  • If we offer a free trial, its length is shown before purchase. If you do not cancel before the trial ends, the paid period begins.
  • We will announce price changes in advance; the new price applies from the next period, and for an increase the store may ask you to accept it.
  • Deleting your Account or the App does not cancel a subscription. Cancel it in the store.
  • When the Premium Plan ends, your data stays. If it exceeds the Free Plan limits, you cannot add new products or Storages beyond the limit until you reduce them or resubscribe.

7. Right of withdrawal

A Consumer may withdraw from a distance contract within 14 days of its conclusion without giving a reason. You can end the Free Plan contract at any time by deleting your Account.

The Premium Plan subscription is purchased through the App Store or Google Play, so the withdrawal notice and refund request go through the store: for the App Store at reportaproblem.apple.com, for Google Play in your Google account order history. You can also write to us at [email protected] and we will help.

If you expressly request the Premium Plan to start before the 14 days have passed and then withdraw, the refund may be reduced in proportion to the period you used the Premium Plan, in line with the Polish Consumer Rights Act.

8. Conformity and complaints

We are liable to Consumers for the conformity of the service with the contract under Chapter 5b of the Polish Consumer Rights Act. If the App does not work as agreed, you can file a complaint.

Send complaints to [email protected]. Describe the problem and include your Account email, device model and App version. We reply within 14 days of receiving the complaint. If we do not reply within that time, the complaint is deemed accepted.

Complaints about the payment itself, e.g. a double charge, are handled by Apple or Google under their own rules.

9. User Content and acceptable use

  • You must not provide unlawful content or content that infringes others’ rights or is offensive, and you must not disrupt the App, e.g. by automated scraping, circumventing limits or attempting unauthorised access.
  • You keep the rights to your User Content. You grant us a non-exclusive, royalty-free licence to store, process and display it as needed to provide the service, including to Household members.
  • The name, brand, category, package size and photo of a product saved with a barcode are added to the shared product catalog and shown to other Users who scan that barcode, without information about who added them. For this data you grant us a perpetual licence that also covers sharing it with other Users. Do not include personal data or photos you have no rights to.
  • Open Food Facts and Open Products Facts data is available under the Open Database License, and photos under Creative Commons BY-SA.

You can report unlawful content to [email protected] (our point of contact for users and authorities, including under the Digital Services Act). Say where the content is and why you consider it unlawful. We handle reports without undue delay and inform you of our decision. We communicate in Polish or English.

10. Product data and liability

Product data comes from open databases and from Users and may be incomplete or outdated. Expiry reminders are an aid only: check the date and condition on the package before eating a product.

We are not liable for the consequences of incorrect data entered by a User or for outages of Apple, Google or internet providers’ services. Nothing in this section limits a Consumer’s mandatory statutory rights.

11. Availability and changes to the App

We aim to keep the App running, but technical breaks may occur, e.g. during updates. We announce longer planned breaks in advance where possible.

We may develop and change the App, e.g. to improve security or support new system versions. If a change materially and negatively affects your access to a paid Premium Plan, we will tell you in advance, and you may terminate the contract free of charge within 30 days of the change.

12. Termination

You can terminate the contract at any time by deleting your Account in the App or by following the Delete account page. The Privacy Policy explains what we delete and what we keep.

We may terminate the contract for important reasons, e.g. persistent breaches of these terms or discontinuing the App, with 30 days’ notice sent by email or in the App. For a serious breach, such as a hacking attempt or providing unlawful content, we may block the Account immediately and give our reasons. If the Premium Plan ends through our fault, we refund the unused period.

13. Disputes

Consumers may use out-of-court complaint and redress procedures, e.g. the help of a municipal or district consumer ombudsman, the Consumer Federation or the regional Trade Inspection. Information is available at prawakonsumenta.uokik.gov.pl.

Disputes are resolved by the court having jurisdiction under the Polish Code of Civil Procedure.

14. Changes to these terms

We may change these terms for important reasons: changes in law, changes in the scope of the service or security reasons. We will announce changes in the App or by email at least 14 days before they take effect. If you do not accept them, you can terminate the contract before that date by deleting your Account.

15. Final provisions

These terms are governed by Polish law. This choice of law does not deprive a Consumer of the protection of the mandatory provisions of the country of their habitual residence.

For an App downloaded from the App Store, the Apple Standard End User License Agreement also applies. Apple is not a party to the contract for the services provided in the App and is not responsible for them.

The Privacy Policy describes how we process personal data.
